1. Eligibility

2. Membership Terms

In order to become a Member, you must register for an account on the Website. When registering for an account, you may be required to provide personal information about yourself, such as your name, email address, and any other information requested by us. You may also be asked to create a username and password. You agree that the information you provide to us is accurate and that you will keep it accurate and up-to-date at all times. Once you have registered for an account, you will be considered a “Member.”

As a Member, you will have the ability to access certain areas and features of the Website and Services that are not available to non-Members. For example, Members can post profile information about themselves, upload photos, send messages to other Members, and search for other Members based on specific criteria.

3. Termination of Membership

Kurdish linkup.com reserves the right to terminate your Membership at any time, for any reason, effective upon sending written notice to you at the email address you provide in your application for Membership or such other email address as you may later provide to us. If we terminate your Membership because you have breached this Agreement, you will not be entitled to a refund of any unused portion of the Membership fees you paid.

4. Modifications to this Agreement

Kurdish linkup reserves the right, at its sole discretion, to modify these Terms of Use or any other terms and conditions governing the Website and Service at any time and from time to time without prior notice by posting updated Terms of Use on the Website. Your continued use of the Website after such changes are posted constitutes your acceptance of those changes, and you will be bound by such revised Terms of Use going forward. Therefore, we encourage you to periodically review these Terms of Use to stay informed of any changes.

5. Modifications to the Service

Kurdish linkup.com reserves the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) at any time and from time to time without prior notice. You agree that Kurdish linkup shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.

6. Fees

Certain features of the Service may require you to pay a fee. If you elect to use paid features of the Service, you agree to pay all applicable fees, as described on the Website and in these Terms of Use. All fees are payable in British pound and are non-refundable, except as provided in these Terms of Use or as required by applicable law.

7. Billing and Payment

Kurdish linkup.com will bill all charges automatically to your credit card or other payment methods that you provide during sign-up. You agree to keep your billing information accurate and up-to-date at all times. If Kurdish linkup is unable to bill your credit card or other payment methods for any reason, you agree to pay all amounts due upon demand by Kurdish linkup. If you dispute any charge made under this Agreement, you must notify us in writing within 30 days after such charge; otherwise, such a dispute will be waived, and you will be obligated to pay such charge.

8. Refunds

Except as required by applicable law, all fees paid to Kurdish linkup are non-refundable. If you cancel your Membership at any time, you will not receive a refund of any unused portion of the Membership fees you paid.

9. Proprietary Rights in Content on the Website and Service

As between you and Kurdish linkup, all content on the Website or that is made available through the Service is owned by or licensed to us and is protected by copyright, trademark, patent, or other proprietary rights and laws. You agree not to modify, copy, frame, scrape, rent, lease, loan, sell for any commercial purpose, or reverse engineer any portion of the Service or Website. We reserve all rights not expressly granted to you in and to the Website and Service.

10. User Content

As between you and Kurdish linkup, all content posted by Members on the Website is owned by such Member (“User Content”). By posting any User Content on the Website, each Member grants to us a perpetual, irrevocable, worldwide, non-exclusive right and licence (with the right to sublicense) (i) to use, reproduce, modify, adapt, perform and display such User Content in connection with providing the Service; and (ii) to store such User Content on our servers. Each Member represents, warrants, and covenants that it has all rights necessary for the grant of the licences set forth in these Terms of Use.

11. User Conduct and Obligations

You agree to use our Service only for its intended purpose and not to:

• Post content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libellous, invasive of another’s privacy or racially or ethnically offensive
• Post any unsolicited or unauthorised advertising or promotional materials
• Post any content that you do not have a right to post under all applicable laws
• Post any software viruses or any other computer code designed to interrupt, destroy or limit the functionality of our Service
• Interfere with or disrupt our Service
• Register for more than one user account
• Collect personally identifiable information about other Members, including email addresses and phone numbers, without their prior consent
• Impersonate any person or entity or falsely state or otherwise misrepresent yourself in a profile or in any other manner
• Post false, inaccurate, misleading, defamatory or libellous content (including personal information)
• Solicit personal information from anyone under 18
• Request money from another Member
• Transmit spam messages to promote products or services
• Send chain letters or pyramid schemes of any kind
• Pose as another person for the purpose of misleading others
• Use our Service for illegal purposes
• Violate these Terms of Use
• Violate our Privacy Policy

12. Termination and Suspension

You may terminate your Membership at any time by following the instructions on the “Settings” page of the Website. Kurdish linkup may temporarily or permanently delete your account without prior notice to you and without liability if: (i) we are required to do so by law; (ii) you are in material violation of these Terms of Use, including without limitation if you use the Services for illegal purposes; (iii) you fail to pay us any fees when due; or (iv) our provision of the Services to you is no longer commercially viable for any reason whatsoever. Upon termination, all rights granted to you in these Terms of Use will immediately cease.

13. Third Party Content and Websites

The Service may include links to third-party websites or resources. You acknowledge and agree that we are not responsible for the availability of such external sites or resources and do not endorse and are not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources. Transactions that occur between you and any third party are strictly between you and the third party and are not the responsibility of Kurdish linkup. Kurdish linkup is not liable for loss or damage of any sort you may incur from dealing with any third party. You should consult with your own attorney regarding these issues if they arise in connection with your use of our Service.

14. Disclaimer

You agree that your use of our Service is entirely at your own risk. The Service, the content, and all user content are provided “as is” without warranty of any kind, either express or implied, including but not limited to any warranties of merchantability, fitness for purpose, and non-infringement. Kurdish linkup does not warrant that the content is accurate or reliable or that the Service will be uninterrupted or error-free. You understand and agree that if you download any materials from our Service, you do so at your own discretion and risk and that you will be solely responsible for any damages to your computer system or loss of data that results from the downloading of such materials. Some jurisdictions do not allow limitations on how long an implied warranty lasts, so the above limitations may not apply to you.

15. Limitation of Liability

You acknowledge and agree that we will not be liable for any indirect, incidental, special, or consequential damages, including but not limited to damages for loss of profits, use, data, or other intangibles arising out of your use of our Service. Under no circumstances will Kurdish linkup’s total liability to you for all damages that arise from your use of our Service exceed the amount paid by you for the Service. Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitations may not apply to you. Kurdish linkup is based in United Kingdom. If you are accessing our Service from outside United Kingdom, please be advised that UK law provides substantial protections for online service providers. However, you understand and agree that the laws of your jurisdiction may provide different or lesser protections for online service providers and that, in any event, Kurdish linkup is only willing to provide the protections afforded under United Kingdom law.

16. Indemnity

You agree to defend, indemnify and hold harmless Kurdish linkup and its officers, directors, employees, agents, and third-party service providers from and against all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising directly or indirectly out of: (i) your use of our Service; (ii) your violation of these Terms of Use; or (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right. This indemnity survives the termination of these Terms of Use and your use of our Service.

17. Assignment

These Terms of Use and all rights granted to you under these Terms may not be transferred or assigned by you but may be assigned by Kurdish linkup without restriction. Any assignment attempted to be made in violation of these Terms shall be void.

18. Waiver and Severability

The failure by us to enforce any provision of these Terms does not constitute a present or future waiver of such provision nor limit our right to enforce such provision at a later time. If any provision of these Terms is found to be invalid or unenforceable for any reason, that provision shall be enforced to the maximum extent permissible so as to give effect to the intent of the parties as reflected in that provision and the remaining provisions of these Terms of Use shall continue in full force and effect.

19. Entire Agreement

These Terms of Use and our Privacy Policy constitute the sole and entire Agreement between you and us regarding our Service and supersede all prior understandings, agreements, representations, and warranties, both written and oral, regarding such subject matter.

20. Changes to these Terms of Use

We reserve the right to modify or replace these Terms of Use at any time. If a revision is material, we will provide at least 7 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using our Service.
